1. Application of Frivolous Litigation Statute to Municipalities (N.J.S. 2A:15-59.1) - Consideration of a Draft Final Report recommending modifications to the Frivolous Litigation Statute in N.J.S. 2A:15-59.1 reflecting the holding of the New Jersey Supreme Court in Borough of Englewood Cliffs v. Trautner, 260 N.J. 410 (2025).  Report

2. Admission Criteria of the Special Probation Recovery Court Program under N.J.S. 2C:35-14(a)(5) – Consideration of a Draft Tentative Report proposing modifications clarifying N.J.S. 2C:35-14 (a)(5) consistent with the Appellate Division’s interpretation in State v. Jones, 481 N.J. Super. 271 (App. Div. 2025).  Report

3. Title 39: Windshield Statute (N.J.S. 39:3-74) – Window Tint Traffic Stops/Citations – Consideration of a Draft Tentative Report proposing modifications to the window tint law in New Jersey consistent with the Supreme Court’s determination in State v. Smith, 251 N.J. 244 (2022).  Report

4Availability of Remedies Under the Uniform Securities Law - Consideration of a Memorandum proposing a project focusing on the availability of statutory remedies pursuant to N.J.S. 49:3-69(a)(2) in the Uniform Securities Law, as addressed in Platkin on Behalf of Kopleton v. Kizito, 481 N.J. Super. 587 (App. Div. 2025).  Memo

5. Clarification of the "Kind-For-Kind” Requirement (N.J.S. 2A:53A-41) in Medical Malpractice Cases - Consideration of a Memorandum proposing a project addressing the “kind-for-kind” requirement in N.J.S. 2A:53A-41 that an Affidavit of Merit is sufficient when the challenging expert is specialized within any of a defending physician's specialties, as held in Wiggins v. Hackensack Meridian Health, 259 N.J. 562 (2025).  Memo


A Tradition of Law Revision, 1987 - Present

With the enactment of N.J.S. 1:12A-1 et seq., the current New Jersey Law Revision Commission was created in 1985 and began work in 1987.

The New Jersey Law Revision Commission is required by statute to “promote and encourage the clarification and simplification of the law…and its better adaptation to present social needs, secure the better administration of justice and carry on scholarly legal research and work.” N.J.S. 1:12A-8.

The Commission does so by conducting an ongoing review of New Jersey statutes and case law to identify areas of the law that require revision. The Commission also considers recommendations from the American Law Institute, the Uniform Law Commission (formerly the National Conference of Commissioners on Uniform State Laws) and other learned bodies as well as members of the legal community and the public.

The Tentative Reports below are distributed to advise interested persons of the NJLRC's tentative recommendations and to offer an opportunity to submit comments. The Commission is actively seeking comments on the reports below.
