The New Jersey Law Revision Commission will meet on Thursday, January 23, 2020, at 10:00 a.m. in the Commission offices on the 7th Floor, 153 Halsey Street, Newark, New Jersey.

  1. Meaning of “Physical Examination” – Consideration of a Draft Final Report proposing a statutory definition for the term “physical examination” for purposes of New Jersey’s Tort Claims Act (N.J.S. 59:6-4). Report

  2. Clarification of Tenure - Consideration of a Draft Final Report recommending modifications to N.J.S. 18A:17-2, to clarify tenure provisions for certain school employees. Report

  3. Books and Records of Account (N.J.S. 14A:5-28) – Consideration of a Draft Tentative Report proposing modifications to the language of N.J.S. 14A:5-28 to clarify the definition of the term “books and records of account”, as followed in Feuer v. Merck & Co., Inc., 455 N.J. Super. 69 (App. Div. 2018). Report

  4. Definition of “Confinement”- Consideration of a Draft Tentative Report proposing modifications to the language of N.J.S. 2C:44-3(a), clarifying the definition of the term “confinement”, as discussed in State v. Clarity, 454 N.J. Super. 603 (App. Div. 2018). Report

  5. Human Trafficking - Consideration of an Memorandum regarding the status of the project pertaining to human trafficking and seeking Commission guidance.  Memo

  6. Magistrate – Consideration of a project proposing statutory modifications to eliminate references to the term “magistrate” from the New Jersey statutes. Memo

  7. Pending Tenure Charges and Back Pay – Consideration of a Memorandum proposing a project to clarify N.J.S. 18A:6-14 to include circumstances highlighted by the Appellate Division in Pugliese v. State-Operated School District of City of Newark 454 N.J. Super. 495 (App. Div. 2018). Memo
